Terms and Conditions

1. Seller information​

1.1. The seller is Klaudia Wojciech, operating as a sole trader registered in Bristol, United Kingdom.

1.2. Business correspondence address: 202 Avonmouth Rd, Bristol, BS11 9LP, United Kingdom.

1.3. Primary contact method: contact form available on klaudiawojciech.art.

1.4. This address is also used for returns, unless otherwise agreed in writing.

2. Scope of services and products

2.1. The Seller oers:

- original artworks

- limited edition ne art prints

- custom-made and personalised artworks (commissions)

- in-person art workshops

- artistic collaboration opportunities​

2.2. Descriptions, pricing, technical details and availability are displayed on individual product pages. Minor variations due to screen settings or the handmade nature of the work do not constitute defects and do not give rise to any right to reject the goods.

3. Orders and conclusion of contract

3.1. Orders and workshop bookings are placed via the website.

3.2. A binding contract is formed once the customer receives a conrmation email.

3.3. For commissions and collaborations, the scope, pricing and timeline are agreed individually via email. Email conrmation constitutes acceptance.

3.4. Work on custom-made items begins only after payment is received. The customer acknowledges and expressly agrees that such custom-made items are excluded from statutory cancellation rights, except where they are faulty.

4. Payments and invoices

4.1. Accepted payment methods include debit or credit card and other electronic payment methods made available through the website at the time of purchase.

4.2. Payment is due in full at the time of ordering or booking.

4.3. Invoices are issued upon request under the registered sole trader business.

5. Delivery, insurance and territory

5.1. Standard delivery is available within the UK.

5.2. Delivery methods include: specialist art courier, standard courier, postal service or collection in person (by appointment).

5.3. Delivery and shipment insurance within the UK are included in the product price, unless stated otherwise for a specic item. The customer is informed of the total price before making any payment.

5.4. Estimated dispatch time for standard orders is 7–14 working days
unless otherwise stated on the product page.

5.5. International shipping is available only by prior arrangement. Any customs duties, taxes or import fees are the responsibility of the customer.

5.6. The Seller selects packaging and insurance appropriate for artworks and suitable for safe transport.

5.7. The Seller is not responsible for delays or non-delivery caused by incomplete or incorrect customer-provided details.

5.8. Risk passes to the customer once the item has been delivered to the address or safe place specied by the customer.

6. Receipt of delivery and transit damage

6.1. Customers are advised to inspect the parcel upon delivery.

6.2. If damage is visible or suspected, the customer should ask the courier to note the issue where possible and contact the Seller immediately, providing photographs.

6.3. Failure to report visible damage within a reasonable time may aect the ability to process a claim.

7.  Product conformity and liability

7.1. Goods must be as described and of satisfactory quality in accordance with the Consumer Rights Act 2015.
7.2. Minor colour discrepancies caused by screen settings, lighting conditions, photography, or the handmade nature of the work do not constitute defects.
7.3. Each artwork is a unique handmade object. Natural variations in colour, texture, brushwork or surface are inherent characteristics of original artworks and do not constitute defects.
7.4. The guarantee does not cover damage resulting from improper handling, storage or inadequate return packaging.
7.5. Limitation of liability:
To the maximum extent permitted by law, the Seller’s total liability for any claim arising out of or in connection with a contract shall not exceed the amount paid by the customer for the relevant product or service.
7.6. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
7.7. Fine art prints are produced using professional printing methods. Minor variations in colour may occur due to printing processes, paper characteristics and screen settings and do not constitute defects.

8. Returns and right to cancel (products)

8.1. Consumers may cancel a distance contract for physical products within 14 days from the day after the day on which the customer receives the goods, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

8.2. The right to cancel does NOT apply to:

- custom-made artworks
- personalised artworks
- commissioned artworks created specifically for the customer

8.3. To cancel the contract, the customer must notify the Seller by email, providing the order number and the title of the artwork. Return instructions and the appropriate return address will be provided individually by the Seller.

8.4. Returned artworks must be packed using the original packaging or equivalent professional packaging suitable for artwork transport. The Seller is not responsible for damage occurring during the return shipment if the artwork has not been adequately packed by the customer.

8.5. The customer is responsible for return shipping costs and is strongly advised to use tracked and insured delivery.

8.6. The Seller is not liable for loss of or damage to goods during the return shipment.

8.7. Refunds will be issued within 14 days after the returned item has been received by the Seller or after the customer provides proof that the item has been returned, whichever occurs first.

8.8. The Seller may deduct any loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

8.9. If the customer cancels the contract, the Seller will reimburse the price paid for the goods and the cost of the standard delivery option offered by the Seller. Any additional delivery costs resulting from the customer choosing a more expensive delivery option will not be refunded.

9. Complaints (faulty or incorrect goods)

9.1. Faulty, damaged or incorrect items must be reported within 14 days of delivery, with photographs and a description.

9.2. The Seller reviews complaints within 14 days and will oer an appropriate remedy (repair, replacement, partial refund or full refund).

9.3. Failure to report a visible issue within this period may limit available resolutions.

10.  In-person workshops

10.1. Workshop details (topic, venue, date, duration, price, capacity) are displayed on the website.

10.2. Places are conrmed only after full payment.

10.3. Cancellation by the customer:

- if cancelled within the timeframe specied in the workshop description, 50% of the fee is refunded

- if cancelled after this period or in case of non-attendance, the fee is non-refundable unless the Seller decides otherwise at their sole discretion

10.4. Cancellation or rescheduling by the Seller:

- the Seller may cancel or reschedule due to illness, low enrolment or force majeure

- customers may choose a full refund or transfer to another date/workshop

10.5. The Seller is not liable for any additional costs incurred by the customer (including but not limited to travel, accommodation or subsistence).

11. Artistic collaborations

11.1. Collaboration projects are governed by individually agreed terms.

11.2. Intellectual property, usage rights and fees are conrmed in writing and take precedence over these Terms where they conict.

12. Personal data

12.1. Personal data are processed in accordance with UK GDPR and applicable data protection laws.

12.2. Data are used only for order processing, workshop bookings, communication, and (where consent exists) marketing communications.

12.3. Customers may request access, correction or deletion of their personal data, or restriction of processing, subject to legal retention obligations.

13. Amendments to these Terms and Conditions

13.1. The Seller may amend these Terms, for example due to legal updates or changes in business operations.

13.2. The Terms applicable to a particular order are those in force at the time of placing the order.

14. Governing law and dispute resolution

14.1. These Terms and all contracts made through the website are governed by the laws of England and Wales.

14.2. Disputes should rst be addressed via email. If unresolved, they may be brought before the courts of England and Wales.
